Wanted to give everyone a quick synopsis of last night's meeting:
AGENDA

Approval of Bills- Approved. There was an issue brought up with the council not being notified about Dale Johnson hauling for the city and the cost difference between the city hauling and Mr. Johnson hauling.
Approval of Water Project CDBG/SRF Bills-
OLD BUSINESS
A. Recycling Fees- There was a motion to approve increasing the recycling bill by $1.00 per month. The council then discussed raising the rates by only $0.50. Council approved raising the rates $1.00 a month per resident household and sending a letter to the county to ask for more funds.
B. 2008-2009 Budget Amendment
C. Ordinance 233 (3rd Meeting)- Approved
D. 31 South Main Street Property Clean Up- Brought up liability concerns of not tearing down the last wall as a town. The council decided to try and get the property owner to help with the cost of this project.
E. Power of Trees Program- The mayor asked the council to think of candidates for a five person committee. Two can be council members.
F. 9th Street Drainage-This drainage needs to be repaired according to the council.
G. Well Project- They have drilled to 1000ft. The goal is to drill to 1250ft. They hope to have this accomplished by Thursday of next week.
H. Water Meter Replacement Program- The council approved by 10 meters with the type to be determined by city employees.
I. Golf Course Superintendent- Devin Gallentine was hired at $500 a week for 5 months
J. Golf Course Maintenance Worker- Hired Tyler Menhusen at $400 a week.
K. Golf Course Clubhouse Cook
L. Lagoon Property Rental Bid
M. Golf Course Petition-Out of Order
NEW BUSINESS
A. Building Permits: Christ the King Church, Storage Shed- Approved; Kevin and Robin Dodson, Retail Building-Approved; Southeast Webster School: concession, restroom building-Approved
B. Fireworks Permit-Approved
C. Bridge Inspection Reports
D. 3rd Avenue SW Drainage and Trees- Will ask the DNR about a potential solution.
E. Animals at Large Ordinance- Police Chief Weiland suggested that the town change the fines for this ordinance from $250 for the first offense and $750 for all next offenses to $25 for the first offense, $50 for the second offense, and $75 for the third offense. The council passed his suggestion.
F. Park Clean Up Project-5th Graders. This was moved up to the beginning of the meeting. Two pupils in Mr. Wisecup’s 5th Grade class asked the council for permission to clean up the park at the school and to raise money for the Humane Society. Council approved of their inquiry.
G. Park and Recreation Secretary Pay- The council approved paying either the City or Assistant City Clerk $25 to take notes at the Park and Recreation Board meetings.
H. 1st American Bank Building- The town has been approached about buying this building. Some have suggested making this City Hall to protect records in the vault. More information will be collected before a decision is made.
I. School Park Update
J. I-JOBS Program- The state has appropriated a sum of money for roads to cities. The town will have to apply for these funds.
K. Franchise Fees- Towns can now again apply franchise fees. The council decided not to apply this.
L. Hazard Mitigation Plan Update-
M. State Ombudsman- The city attorney addressed the council and those in attendance from 40 to 50 minutes addressing a variety of issues.
N. Comments from the floor- There were several comments from the floor.

ReplyDeleteMr. Benson got a lot of grief for things that he did long ago. That was out of line. His behavior in the recent past is another matter. He was castigated for being obstructionist. It was stated from the floor that, "Kevin (Benson), the only time you say yes to anything is when the opening roll call is taken." That was a pretty accurate statement. The bottom line is that Benson and Vegors believe in democracy only when they are getting their way. When it goes against them they obstruct and pout worse than any two kindergarten children I have ever known.
ReplyDeleteI agree about his past we all have skeletins in our closets and unless they do directly effect his councelman duties they should remain his past. I think there is other people on the council that have somethings in there past they wouldn't want aired in a meeting.

ReplyDeletemembers, there were also many in the audience that have things in their past. Whether it be of legal nature or not. I personally wouldn't go that direction. Interesting how some minds work.
In the 1960 Presidential election it was clear that Richard Nixon had been cheated out of a victory because of the counting of votes in Mayor Daley's Chicago. Many of the votes cast were by dead people. Many of Nixon's advisors wanted him to contest it. For the good of the country Nixon refused. No matter what he became later that was an act of an honorable leader that put his country's interests ahead of his own. Mr. Benson should take a lesson from Mr. Nixon's actions. Whether Mr. Benson is right or wrong has become irrelevant. He is divisive. It is time for him to go.
ReplyDeleteIf those who think Mr. Benson should resign be he right or wrong, then get rid of most of the council and the Mayor. The hiring of a councilperson's son has been controversial as well. Is it right or wrong to cast a vote for your own son? Legally, according to the City Attorney, it is. Is it ethical? Most would say no. A lot of innuendos have surrounded the Mayor for his board appointments as well. So if Mr. Benson needs to resign for the good of the community, so should the Mayor and at least one councilperson. I am not casting aspersions to either of them, but since some think Mr. Benson should do the honorable thing, then so should the others. I think their is doubt that the whole council can act in the best interest of the town with all this going on.

ReplyDeleteThere is a difference. The other members of the council may be right some times and may be wrong some times, but they are trying to solve problems and move forward. Mr. Benson does everything he can, unethically and probably illegally on occasion, to block any forward movement. The quality of the councils decisions is no longer the issue. Often, even a bad decision is better than no decision at all. Anyone who thinks the council will not function more smoothly without Mr. Benson on it has either never been to a meeting or is so biased as to be deaf, dumb, and blind. The point is we need a functioning city government. We can not have that as long as Mr. Benson is a part of it.

ReplyDeleteIt is true, two of the other council people have dirty laundry, but it is o.k. for them to stay because they are golf course advocates.
ReplyDeleteShake the tree hard, maybe more of them will fall. We have crooked people all over our Government and that is out of reach because money talks. But when it is local SOMETHING can be done about it!
ReplyDeleteI think that the olive branch should be offered and that the council should try to get along. I believe they all have the best interest of the community involved but that the golf course has caused a deep division. Negativity is just not with Mr. Benson and Mr. Vegors, if you look there is so much negativity. Just look at the majority of the posts to this blog today. What would be the purpose of having Mr. Benson off the council. Is it truly because of his opinions or is it the tally of the votes? I have tried to remain fair and balanced. It's to bad that this cannot become contagious. The comments that were made go very deep. You need to remember if you run a business in a community with division it can affect your business. So I would say that this needs to be worked out with the current council members. You cannot just keep replacing council members until you get whom you want. A council that always voted yes would also not be effective. So please try to rethink your anger. Is it helping you? Is it helping the community? No.
ReplyDeleteIt's time to try and get along. You might be surprised of the outcome. I have been watching this from the start and has gotten uglier and uglier. Not just Mr. Benson and Mr. Vegors. Let's look at people telling others to shut the F____ up. Is that getting along no. Sometimes silence is golden. This meeting last night has divided the community deeper. With visiting with people today it's probably not dividing the way that it was planned. Just food for thought. TRY TO GET ALONG. Look at your past and think about your future are there things you wouldn't have done. Are there things you want pointed out in a public meeting no. I think the Harper Valley PTA song is starting to fit this situation. It should not have been brought to this but it was last evening.
My suggestion; if you didn't witness this first hand, talk to a couple people who did and get a couple different takes on it so you are not biased one way or the other.
ReplyDeleteI did witness this first hand. It's been on my mind since but I'm still not sure how I want to express my thoughts about it - or if it's even the right thing to do in this forum.
It is important as a citizen you ACURATELY know what happened last night-so ask someone you trust to be objective and keep your mind open to other possibilities. It's far past golf course issues anymore.
For now let me close by saying it is now more important than ever to participate in local government and talk directly to our elected local city officials.

ReplyDeleteIt has became far past golf course issues. I was there last evening. I still think the olive branch would work. But all need to come together. I think this could be achieved. I am still looking at this objectively at this point. It is very important to talk to out city officials. I also believe that stones probably should not have been cast as there are many more stones.

ReplyDeleteMany recent...activities (I don't know how else to put it) of Mr. Benson's and Mr. Vegor's were discussed on different issues. The potential legalities and ramifications of these actions were discussed. There was discussion regarding Mr. Benson's concern of others of breaking the law in comparison to his personal legal history.

ReplyDeleteIt was another very divided and eruptive council meeting. Because of the negative nature of these meetings, city business cannot be attended to appropriately. Personally, I was a little uncomfortable with the attention brought to Mr. Benson's past even though Mr. Benson had, himself, brought it up during at least one prior council meeting that I am aware of. I think people do things when they are younger that they are not necessarily proud of. I was not really focused on his past history, but rather the fact that he is so very negative about everything; that he will just disagree for the sake of disagreeing; not really thinking of the best interests of the city as he claims. I don't think he is a bad person, but rather just a very, very bad voice for the people. That is the reason that I thought Mr. Benson should consider resigning from the council. It used to be that city employees were respected members of the community........I can honestly say that for the past couple of years, that has not been the case at all. All fear loss of their jobs and have been seriously disrespected by some members of the community and a couple of council members. So much so that you could almost say they are working in a hostile work environment. Again, they too are not able to attend to city business. I have lived in and around Dayton for 40 years and never have I seen such division in our community. I think it is unreasonable to think everyone is going to agree with everything but truly these two gentlemen on the council need to come to these meetings with a plan to be respectful of their position and be willing to negotiate in the best interests of the city. It is a sad day!

I think we all need to remember that there is in fact 2 council members that are disrespectful NOT just Mr. Benson, Mr. Vegors shows disrespect as well.
ReplyDeleteFor those who do not know, a reporter and photographer from the Des Moines Register were there taking pictures, notes and appeared to interview some people. We'll have to see what that outsider's opinon is.

I think Dayton's drama being published in the Des Moines Register will only do worse things for the city. The last thing we need is others knowing that we have a city councel that can't get along with others.

as well informed then. I don't think the newspaper covered in such debt. as it has this. But I do remember all of the negative nasty things that were being said and the attack on your husband and I felt terrible for him. I know that you stayed and raised your children here and that was good, I'm sure it was hard at times.
Thank you 8:54! It is sad we can't tell who we are speaking with and who has what opinion......Yes it was extremely hard but as I'm sure many of you have told your children time and time again..."Life isn't fair"... I prefer not to dwell on the past and instead look to the future.

You will be getting everything second and third hand and of course it will be distorted and changed 100 times. Don't spread rumors and stories you didn't witness. I was there and let me tell you I have sat back and watched personally how Mr. Bensen is disrespectful to the "WOMEN" on our council as well as our Mayor and believe it or not Mr. Diehl. He has been nasty to everyone of the council members except Norm. I personally have looked up in the public records on the internet all of our council members including our Mayor and I think that one of the things that Mr. Bensen had against him was not getting his bills paid on time, which in turn makes me wonder how he can represent our city! As I said at the meeting last night in front of everyone this is pretty sad that our community has fallen apart and has turned out to be so hateful, just breaks my heart.
ReplyDeleteOne thing that truly upset me that I didn't find out until last night at the meeting was that Mr. Vegors and Mr. Benson tried to get our Police Cheif Weiland and Mr. Pigman to not give them back their jobs when there were in Kosovo serving out country. "NOW THAT REALLY DISTURBS ME" how many people knew about this? That is a "FEDERAL OFFENSE" they can legally sue the city and they have no set time they can do this 50 years from now. COME ON PEOPLE what does that tell you? They were over serving our country and look how they were treated............... this is a disgrace to our city.

Is is good idea to pay the 19 to 20 year old grounds keeper just a little bit less than the chief of police. I would have thought you would have noted this. I believe it had something to do with wages and working some days. I am very proud of these two gentleman and are very glad that they are our police force, even though I understand Mr. Pigman is resigning. I believe we owe them a great big thank you for serving our country and our community.

I cannot think of a more tragic situation than to lose your child.....it is just not supposed to happen that way. My heart goes out to the Dodson family but I believe this blog site is becoming more detrimental to the situation we have in Dayton. Neighbors against neighbors and friends against friends. I believe some points here are valid and others are lies or half-truths. What can be done to heal our community? Respect, compassion, caring, humility, tolerance have all gone by the wayside. I truly believe that if a disaster were to strike in Dayton that the people would respond qwuickly and appropriately....PEOPLE: THIS SITUATION IS OUR DISASTER! I don't know Cindy well but I have decided she is a good person that we all should listen to.
Correct me if I am wrong, when has anything been said about the Mayor not paying his bills by anyone, I don't believe I have read or heard that anywhere. As far as the two policemen, they are two great guys. I believe the controversy was that maybe the Chief could have worked at the concert last year, as we could have used an experienced officer there. As you know, we had tornados in the area and lots of people. I believe some healing can take place if we ALL take some time, reflect on our part to play in all this and be honest. I think we should place princibles before personalities. Yes Robyn, I emphasize with your pain. In a small town like Dayton, we all see others problems with how they deal with life. But latly everything has been blurred by half truths and inuendos. Yes Dayton has to heal, but it will take all of us to do it. Common ground has to be found. The golf people and the people that can't or don't want to pay for it have to come together. Let's hear some solutions on this blog on how we can accomplish this. I don't think calling for resignations and character assasinations have worked so far, this has happened on both sides. If we all stop and think, reflect on how we can do things differently, we can all heal, and we all pray that Robyn and her family can heal from this tragedy and all the families that were involved can heal also.
ReplyDeleteThis will be the first and last time I look at this. I was told to take a look and see what was wrote. I will only answer this one time because there shouldn't be any great debate over it. After returning home from Kosovo last year we needed time to decompress from the situtation that we just went through. We went from carrying automatic weapons every where and I mean everywhere (to include the shower) we went. We helped to protect people we didn't even know and we would have given our lives to do so. I think that if you what to judge us and tell us that we need to work right away when we come home and after being away from our families for a year I think that you should have to walk a mile in our boots before you answer that question. I don't think that comparing deployment stories from other people to ours can be justified. If you were deployed be proud of the work that you accomplished and be glad that you made it home. For those that weren't be happy for those that have and come back alive. Also please show them some respect I feel that they have earned it. As for having some time off when you get back where does it say that anybody other than the soldier that was there has the right to decide when they go back to work. We don't ask for much just our time that we have earned. If you feel that you want experience what we go through I have the number for the nearest Recruiter. So please don't try and judge us for things that we have earned. After all we do like to spend time with our families.

Hello, all I would like to thank everyone for their support. Being away from your family is a long aginizing event. We had just got back from Kosovo and no one had even asked us to work the concert. But, my children needed me more than the town I hate to say. After I got home they did not want me to leave their site. Also, to some it up, the Chief and I were on federal orders, it would of been illegal for either one of us to work for the city of Dayton. I don't think that has ever really been brought up but is should be. I do apologize for not being there when the city needed us but are hands were tied by the law and our families. Well, enuff about that, for all you that want to know I am resigning from the city of Dayton. I will be done in about two months. I want to say that I enjoyed working here and the people. the town has a good Cheif and i hope they can keep him. Anyway that is my two cents, if you ever want to ask me something just catch me on the street.

T think those involved in our city and using their voice would look at themselves and read the above versus to see where they stand.

ReplyDeleteMaybe the Dayton Observer is more intelligent than most and is thinking of other things but is smart enough to think of all of the ramifications. When you start the fight or make these open comments you had better be prepared to take the heat. No matter what has happened in your recent or not so recent past.

I would like to know others criminal history as well. Since some people have to get their dirty laundry aried in front of everyone, I find it fair that it happens to everyone. If I knew how to look it up I would air it.
ReplyDeleteIowa Courts online search. You won't need to pay. Be sure to check the birthdates to make sure you have the right people. Be sure to check all counties. Go to Google and search Iowa Courts online. Be sure to check your own first, I did because I didn't want to cast any stones unless I was free and clear, which I was.
ReplyDeleteAs far as out of state criminal searches you will need to pay for this, but it is worth it.
ReplyDeleteIs a person's past legal history relevant to their current postion? Should the public be made aware of their elected official's past history?
ReplyDeleteIn a manner of speaking, I personally liken it to applying for a job (I am aware of the obvious differences too).
If you are hiring a person to drive a vehicle, their past history with driving violations or OWI would be very relevant.
If you are hiring a person to manage your finances, their history with their own personal finances would be relevant.
If you are hiring a person who will have actual or perceived power over others, their history of violence or intimidation would be relevant.
Mistakes - people make them.
I enjoyed the religious posting earlier and it could be applied to both sides. Also, I agree with an above post; be sure to type your own name in Iowa Courts on line along with the names of your family and friends. You will be surprised what you find. Would you want them judged in the same way you are about to judge others? The ultimate goal of rehabilitating a person who has been in prison is to have them productively rejoin society which means they would need the opportunity of employment.
For me personally; I tend to look at if a person made a one time mistake or is it a pattern? Does a person with multiple violations show a pattern of inability to follow rules? Do they continue to show the behaviors for which they received legal violations or was it a single mistake from which they learned and deserve another chance?
Everyone has made mistakes, regardless if they are on Iowa Courts on line or not. Before you start throwing stones as the 3:46 and 3:31 posts suggest they are ready to do - all wars have inocent collateral damage. Are you sure the next person in the line of fire won't be your family or friend?
I think the reporter knew about other past human mistakes that the other councilmembers had, but she must have thought they were O.K. because they were voting for the 35 to 40 members from the city of Dayton. The real point is: do we air everyone's past HUMAN MISTAKES now or do we move on. If all the truths come out now, and they will, some will have the same shame to face as you have put on others for committing HUMAN MISTAKES. Bad relationsships, addictions such as alcohol, drugs, sex, and overeating, and just wanting to hurt people can be gotten rid of by working diligently to look at youself first and then working on your problems and not hurting others. I hope you can all stop lying to yourselves. This golf course issue is all about power and control, just like abusive relationships, you are going to have a golf course and you are going to get it no matter how many citizens you are going to hurt by taxation and any other dirty deeds you can do.

ReplyDeleteIt was NOT a threat. You should treat other's as you want them to treat you. Before people start throwing stones, they should stop and think how they would feel if the same thing was happening to them or their loved ones.
It wasn't a tit for tat suggestion. It was a comment in regards to the exact oposite. As the 5:07 post said, there are no winners in war.
Dayton Taxpayer Why don't you go on Iowa courts and check the people out for yourself you maybe surprised. Small claims court are also on there. I did check myself and my family. I could air all of my laundry because it is clean. Why now should the airing of laundry stop? Because the attack was already done? I won't post this because I will not be that type of attack horse. I have to much class and also I will not hurt people in that way.

ReplyDeleteI can see the point of having a civil debate and I do enjoy debating politics. A couple weeks ago I was pretty upset about a topic and decided to take a break from it. At the time, Samaddamslite, Daytontiger, Daytonflyer all asked me to reconcider and come back to the debate.
Those 3 have been noticibly gone (or haven't signed in with their screen name) for the past couple days. It's been noted the Daytonobserver is reporting in a quite different format now. Clearly the real personal side of this blog is affecting both sides. The low blows have gotten lower and I have seen the real negative affect this has had on people I know to be good people and I care about.
Although I think Dr. Phil is a complete pompous ass; he does have a few good sayings that I feel pertain to this situation: "No matter how flat you make a pancake, there are two sides. Past behavior is the best predictor of future behavior. And---if you aren't part of the solution, you're contaminating the problem."
So...I'm going to quit lying to myself and believing there is a way I can bring some peace to this situation through this blog. This is out of hand and I'm just contaminating the problem. I'm also going to practice what I preach and see MORE of the city council members to discuss this situation in person. I'm going to be part of the democratic process as it was meant to be.
Remember, this fight is with you friends and neighbors; the people you will need to rely on in a real disaster. Note the other subject on the DM Reg. website - The Parkersburg tornado. We can agree to disagree and treat each other with dignity and respect. I hope there will be a champion within the city council who extends an olive branch to help resolve this issue.
I will keep both sides in my prayers and I hope you all will too.

ReplyDeleteI think, only a suggestionn and not casting any blame, I would like to see a couple of the Park and Rec board step aside and the Mayor appoint some non-golf minded people. This is only offering the citizens a chance to have an open-minded group looking at both sides, and then maybe there could be some trust rebuilt. There has been so many complaints and counter complaints and then a movement to absolutly discredit some people in an absolute manner that leaves them to no alternative other than to retaliate. I would ask those individuals to act with dignity and grace, the truth always seems to come out in the end. Let's all act as how our GOD has taught us to act. I don't see this happening now.
ReplyDeleteDaytonTaxpayer: I have not blogged for the past few days because I didn't know what to say. I think that there could be peace from this blog. I honestly didn't want to come across with negativity. I find that if I give myself time I am not angry and don't say things I should not. I have prided myself in trying to always see both sides professionally and in my own private life. I have also found that I need to be strong in my convictions to keep going and this does cross over to any cause I feel strongly about. I hate this negativity. It honestly makes me feel ill.
ReplyDeleteI have tried to think of a positive solution to solve this problem. The olive branch is a good idea. Maybe this would work. I remember one council meeting I was at everyone left laughing and talking and I thought there was hope. Where did this go? Boy, where did all of this go wrong? I still don’t quite know what to say. It is sad to have friends, neighbors and our community at such odds. I think this problem is bigger than just Mr.
Benson, Mr. Vegors and Mr. Carstenson. Maybe I’m the problem, I don’t know. This
problems needs to be solved. Maybe somehow we could do it together. Thank you

I see I am missed on this blog. Just kidding. But really, I have just been sitting back watching and reading and shaking my head. As most have said this is getting way out of hand. I just want to address a couple of points neither really for or against anybody in particular, just the way it has been handled. I was not at the meeting, but do have a copy of the meeting on CD which can be obtained at city hall. Our city attorney in my opinion made a mockery of our justice system. It is not because of his attack on Mr. Benson per se, but the way he did it. He was very careful with the words he picked. He never said Mr. Benson had been convicted of the serious things such as stalking or DUI, just that he pled them down to lesser charges. However he basically implied that Mr. Benson was guilty. At least that is how it looked to me. It is Mr. Benson's right as a citizen or council member to go to the Omsbudsman concerning things he does not think are right. It is the right of any citizen to do so. Our city attorney said that. What I think was really out of line was attacking Mr. Benson personally, when if you go to Iowa Courts Online you will find undesirable things on others involved. Public knowledge. I will not say who or what the charges are, but look it up if you want. I don't care what any have done as long as it is not directly involved with the city. What has happened, is over and done and should be left as such. As far as I am concerned that should never have been brought up at all about Mr. Benson or anyone else. It has nothing to do with what is going on in this town. Public knowledge or not it has nothing to do with Mr. Benson's actions in regards to what people think he is doing. I have been to many council meetings and have never seen anyone on the council be disrespectful to any other council member. Not to say they have not had heated arguements about an issue, but I have never heard anyone call another dumb, stupid, ugly, or anything else. On the CD, as some in person have told me, Mr. Benson asked councilperson Gallentine about the living arrangements with her son regarding rent etc. He gave his reason first and then asked. Was that the best thing to ask, most likely not. Was is disrespectful? No. No one that I have talked to said he accused her of anything and I didn't hear it on the CD. You might not like what he said and that is fair. I don't like to see anyone arguing over half the stuff that is flying here. Personal accusations have no place here either. Like I said who has done what, is his/her business. I would be more worried about financial messes than a DUI. The town's council decides financial issues and that is where we need some good minds. Let's see if we can talk about these thing without the personal side of it. I like to spar with Taxpayer and Al who is no longer here I guess. If you don't agree with me, that is okay. Just don't get so nasty about someone not agreeing with you. That is not pointed at anyone, just everyone in general.
